Terms of Service
Last updated: March 2026
1. Agreement to Terms
By accessing or using the website homerating.com.au, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the website. HomeRating is operated by HomeRating, an Australian entity.
2. Description of Service
HomeRating is an online directory connecting homeowners with accredited NatHERS energy rating assessors across Australia. Our services include:
- A searchable directory of NatHERS assessors
- Assessor profile pages displaying business information, accreditation details, and service areas
- A lead form enabling homeowners to contact assessors directly
- Educational content about energy ratings, NatHERS, and climate zones
HomeRating is a platform that facilitates connections between homeowners and assessors. We are not a party to any agreement between a homeowner and an assessor, and we do not provide energy rating services ourselves.
3. User Accounts
Assessors may create accounts on HomeRating to manage their listings. When you create an account, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain the confidentiality of your account credentials
- Accept responsibility for all activity that occurs under your account
- Notify us promptly of any unauthorised use of your account
We reserve the right to suspend or terminate accounts that violate these terms or provide false information.
4. Assessor Listings
Assessors who register on HomeRating must provide accurate accreditation and business information. All listings are subject to admin approval before they become publicly visible. HomeRating does not independently verify the accuracy of assessor-provided information beyond an initial review.
We reserve the right to remove, suspend, or modify any listing at our discretion, including but not limited to cases where information is found to be inaccurate, misleading, or in violation of these terms.
5. Homeowner Enquiries
When you submit an enquiry via the lead form, your contact details (name, email, phone number, and message) are shared with the selected assessor so they can respond to your enquiry.
HomeRating is not responsible for the assessor's response time, the quality of services provided, or any agreement entered into between a homeowner and an assessor. Any contract for energy rating services is solely between the homeowner and the assessor.
6. Intellectual Property
All content on homerating.com.au, including text, graphics, logos, icons, images, and software code, is owned by HomeRating or its licensors and is protected by Australian copyright law under the Copyright Act 1968 (Cth).
You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from this website without prior written permission from HomeRating.
7. Acceptable Use
When using our website, you agree not to:
- Submit false, misleading, or fraudulent information
- Use the service for spam, harassment, or any illegal purpose
- Attempt to circumvent, disable, or interfere with security measures
- Scrape, crawl, or use automated means to collect data from the website without our written consent
- Impersonate another person or entity
- Interfere with or disrupt the operation of the service or its infrastructure
- Use the service in any manner that could damage, disable, or impair the website
8. Limitation of Liability
To the maximum extent permitted by Australian law:
- HomeRating provides the service on an "as is" and "as available" basis without warranties of any kind, whether express or implied
- We do not warrant that the service will be uninterrupted, secure, or error-free
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service
- Our total liability for any claim arising from the service is limited to the amount you paid (if any) for use of the service in the 12 months preceding the claim
Nothing in these terms excludes or limits consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
9. Consumer Guarantees
Under the Australian Consumer Law, our services come with guarantees that cannot be excluded. For major failures with the service, you are entitled to:
- Cancel your use of the service
- Receive a refund for any amounts paid
You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems rectified in a reasonable time.
10. Indemnification
You agree to indemnify, defend, and hold harmless HomeRating, its officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms of Service
- Your use of the service
- Any content or information you submit through the service
- Your violation of any applicable law or the rights of any third party
11. Privacy
Your use of the service is also governed by our Privacy Policy. By using the service, you consent to the collection and use of your information as described in the Privacy Policy.
12. Modifications to Service
We reserve the right to modify, suspend, or discontinue any part of the service at any time and without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.
13. Changes to Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the service after any changes are posted constitutes your acceptance of the revised terms.
14. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Australia. Any disputes arising from or relating to these terms or your use of the service will be subject to the exclusive jurisdiction of the courts of Australia.
15. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
